REGULATORY INTELLIGENCE / SELECTED 2026 CASES

When the evidence
faces scrutiny.

Recent FDA and European regulatory setbacks offer useful lessons on trial design, analysis, scientific reporting and data quality. Read the original publications and understand what was actually decided.

CURATED RESEARCH / AS OF OCTOBER 24, 2026

Four real decisions.
Four questions worth asking.

A Complete Response Letter (CRL) means FDA did not approve a particular application in its present form; it is not a permanent rejection or a judgment that the company cannot succeed in the future. A CHMP negative opinion is a European regulatory recommendation that may be subject to re-examination before its final outcome.

These are selected public 2026 examples, not a comprehensive or automatically refreshed list. Each case links to a source for precise details and subsequent developments.

FDA / JUL 02, 2026/01

Orviglance — Ascelia Pharma

Complete Response Letter; development path under discussion

The FDA issued a complete-response letter for Orviglance. In an October 11 update, Ascelia said the agency maintained that additional clinical evidence was needed, while acknowledging that a prospective re-analysis using a different primary endpoint might potentially contribute evidence. Ascelia reported no major safety concerns were identified.

EMA / SEP 17, 2026/02

Xervyteg — MaaT Pharma

Confirmed negative CHMP recommendation after re-examination

EMA confirmed its recommendation to refuse marketing authorisation for Xervyteg, intended to treat acute graft-versus-host disease. The agency said available evidence did not establish safety and effectiveness or quantify clinical benefit sufficiently to support a favorable benefit-risk conclusion.

EMA / JUL 23, 2026/03

Qezzaqar — CATS Consultants

Initial negative CHMP opinion; re-examination requested

EMA cited limited progression-free survival gains that were not supported by other effectiveness measures, plus uncertainties about data robustness and baseline group imbalances. The applicant requested a re-examination; this case is shown as an initial negative opinion, not an irreversible final decision.

FDA / MAR 16, 2026/04

Reproxalap — Aldeyra Therapeutics

Complete Response Letter; appeal announced September 2026

Aldeyra described a March FDA complete-response letter stating that the totality of completed trial evidence did not support effectiveness for dry eye disease. On September 29, the company announced plans to submit a formal dispute resolution request; the appeal was prospective at that time.

CASE-STUDY NOTE: COTA was not involved in the identified applications and does not claim these outcomes could have been prevented by an outside consultant. Any potential role for COTA in similar matters would be engagement-specific and focused on scientific analysis, programming, review, or documentation—not promised regulatory results.
HOW COTA HELPS

Better questions.
Before the deadline.

The practical response to regulatory uncertainty is careful study planning and transparent scientific work. COTA supports the technical decisions that help teams understand their evidence and communicate its limits.
